Terms of service
YOUR USE OF THE PROPRIETARY Prepaverse® SERVICE OFFERED AT PREPAVERSE.AI, FURTHERMORE AT BLOOMIE.AI (THE “SERVICE”), IS SUBJECT TO THESE TERMS OF SERVICE. IN ORDER TO USE THE SERVICE, YOU MUST AGREE TO BE BOUND BY THESE TERMS OF SERVICE (“AGREEMENT”) WITH PREPAVERSE GmbH, ITS SUBSIDIARIES AS APPLICABLE (COLLECTIVELY, “PREPAVERSE", "WE", "US", AND "OUR"). IF YOU DO NOT AGREE TO ALL TERMS OF THIS AGREEMENT, YOU MAY NOT USE THE SERVICE.
By signing up for the Service on behalf of a client, you confirm that (a) you are duly authorised to represent the legal entity under which the client operates and any affiliates of the client who will be using the Service under the client, (b) you accept the terms of this Agreement on behalf of such legal entity and its affiliates, and (c) any references to "you" in this Agreement refer to such legal entity, its affiliates, and all of the employees, consultants, and agents of those respective parties. You are responsible for all activity on the Service that occurs under your account.
These Terms of Service ("Agreement") govern your use of the Prepaverse’s web-based platforms such as Bloomie ("Service") provided by Prepaverse GmbH ("Prepaverse," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by this Agreement. If you do not agree with any part of this Agreement, you may not use the Service.
User Obligations
1.1. Eligibility: By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this Agreement.
1.2. Account Registration: You may need to create an account to access certain features of the Service. When registering, you must provide accurate and complete information and promptly update any changes to keep it accurate and current. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
1.3. Compliance with Laws: You agree to comply with all applicable laws, regulations, and third-party rights while using the Service. You are solely responsible for obtaining any necessary permissions, licences, or consents for the content you upload or share on the Service.
Service Description
2.1. Prepaverse services & Bloomie platform : The bloomie platform provides job candidates with learning content, interview structures, and templates to practise for job interviews. Additionally, it offers hiring managers and recruiters the ability to facilitate a hiring process, create hiring frameworks and access relevant resources.
2.2. User Data: As a user of the Service, you acknowledge and agree that Prepaverse through its platforms such as Bloomie.ai may collect and process certain data, including personal information, as described in our Privacy Policy. We collect this data to optimise and improve our product, enhance user experience, and provide personalised recommendations and insights. By using the Service, you consent to the collection, use, and disclosure of your data in accordance with our Privacy Policy, which is aligned with Swiss Federal Act on Data Protection regulations and the General Data Protection Regulation of the European Union
Intellectual Property
3.1. Ownership: Prepaverse retains all rights, title, and interest in and to the Service, including all associated intellectual property rights. This Agreement does not grant you any ownership rights to the Service or its content.
3.2. User Content: You retain ownership of any content you submit, upload, or display on the Service. By submitting content, you grant Prepaverse a non-exclusive, worldwide, royalty-free licence to use, reproduce, modify, adapt, distribute, and display such content solely for the purpose of providing the Service.
Prohibited Conduct
You agree not to:
4.1.1. Use the Service for any unlawful, harmful, or unauthorised purposes.
4.1.2. Interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure.
4.1.3. Collect or harvest any information or data from the Service without our prior written consent.
4.1.4. Upload, post, or transmit any content that is offensive, infringing, or violates the rights of others.
4.1.5. Attempt to gain unauthorised access to the Service or its related systems or networks.
4.1.6 By using the Prepaverse Service, you agree that you will not copy, duplicate, or extract data from the platform, except as expressly permitted by the functionality of the Service or with the prior written consent of Prepaverse
Limitation of Liability
5.1. Disclaimer: The Service is provided on an "as is" and "as available" basis. Prepaverse does not guarantee that the Service will be error-free, secure, or uninterrupted. Your use of the Service is at your own risk.
Prepaverse GmbH shall not be held responsible or liable for any loss, damage, or other consequences resulting from a user's decision not to use or implement the content, advice, suggestions, or processes available on the website, including, without limitation, hiring frameworks, interview questions, and preparation content. Prepaverse GmbH is not liable if a job candidate's application, submitted through any of Prepaverse's platforms, is deemed unsuitable due to its layout, format, content, type of information, or lack thereof. We present the documents to the hiring party as they were received.
Furthermore, Prepaverse GmbH is not responsible or liable for any misconduct or non-compliance regarding questions asked of applicants during the application submission process or for any non-compliant content within documents uploaded by applicants. The creation, content, and compliance of such questions and uploaded documents are the sole responsibility of the user providing or submitting them. Should any user wish to report a case concerning misconduct or non-compliance, they are free to do so by contacting info@bloomie.ai. Prepaverse will investigate such reports in due time (within 15 working days) and provide feedback.
5.2. Limitation of Liability: To the maximum extent permitted by law, Prepaverse and its affiliates, officers, directors, employees, and agents will not be liable for any indirect, incidental, consequential, or exemplary damages arising out of or in connection with your use of the Service.
5.3 Job Board Integration Functionality: Prepvaerse Gmbh through its platforms such as Bloomie offers integration with various job boards, allowing you to seamlessly advertise your job openings across multiple advertising platforms. You have complete control over platform selection and are responsible for any associated costs. During integration, Bloomie transmits only essential job details to the chosen job boards, including but not limited to:Job Title, Job Description,Job LocationJob Type.Company Information,
Your Responsibilities. It is your sole responsibility to review and comply with the terms and conditions established by each job board, including data privacy policies and cost structures. Bloomie assumes no liability for the content or practices of external job boards.
5.4 Use of Sub-processors The Client acts as the "Data Controller" and authorizes Prepverse, as the "Data Processor," to engage third-party sub-processors to support the delivery of the Services. This constitutes the Client's general written authorization as required by applicable data protection laws, including GDPR.Prepaverse will enter into a written agreement with each sub-processor, imposing data protection obligations that are at least as protective as those in this Agreement. Prepaverse remains fully liable to the Client for the performance of its sub-processors. We will provide the Client with advance written notice of any changes to this list. The Client may object to a new sub-processor within 14 days of the notice on reasonable, data protection-related grounds.
Termination
6.1. Termination by You: You may terminate this Agreement at any time by discontinuing your use of the Service and deleting your account.
6.2. Termination by Prepaverse: Prepaverse reserves the right, in its sole discretion, to suspend, disable, or terminate your access to the Service at any time, with or without cause or notice.
General Provisions
7.1. Modifications: Prepaverse may modify this Agreement at any time by posting the revised version on the Service. Your continued use of the Service after any such modifications will constitute your acceptance of the updated Agreement.
7.2. Governing Law: This Agreement will be governed by and construed in accordance with the laws of Switzerland Code of Obligation. Any disputes arising out of or in connection with this Agreement shall be resolved in the courts of Switzerland.
7.3. Entire Agreement: This Agreement constitutes the entire agreement between you and Prepaverse GmbH concerning the subject matter herein and supersedes all prior or contemporaneous communications and proposals, whether oral, written, or electronic.
